ELLETT, Justice: Prior to the accusation made in the instant case, the appellant was incarcerated in the Utah State Prison on a charge of being an habitual criminal. The term of his sentence was not less than fifteen years. (Section 76-1-18, UCA 1953). This means that unless the board of pardons releases the appellant, he will spend the remainder of his life in prison on that charge.
